These Terms of Service ("Terms") form a binding agreement between you and Tungo Media ("we," "our," or "us") regarding your use of the Gostado mobile application and any related websites and services (together, the "Service").
By creating an account, or by otherwise accessing or using the Service, you confirm that you have read and agree to these Terms. If you do not agree, do not create an account and do not use the Service.
How we handle your personal data is described separately in our Privacy Policy, which forms part of these Terms.
Gostado lets football supporters check in at stadiums, collect badges and experience points, compare themselves with friends and other supporters, follow matches, make predictions, and share photos of the grounds they visit.
The Service is provided for entertainment purposes. Match data, fixtures, results, line-ups and statistics are supplied by third-party data providers and may be incomplete, delayed or incorrect. We do not guarantee the accuracy of any sports data shown in the Service, and it must not be relied on for betting, financial or other decisions.
When using the Service, you agree not to:
Behave sensibly and lawfully at stadiums. Never put yourself or anyone else at risk in order to check in or take a photo, and always follow the rules of the venue and the instructions of stewards and local authorities. Your safety is your own responsibility.
"Your Content" means anything you upload, submit or post through the Service, including stadium photos, profile avatars, captions, usernames, comments, check-in data and any other material.
You retain ownership of Your Content. Nothing in these Terms transfers your copyright to us.
By submitting Your Content to the Service, you grant Tungo Media a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable and sublicensable licence to use, host, store, cache, reproduce, modify, adapt, edit, crop, translate, combine with other material, create derivative works from, publish, publicly display, publicly perform, distribute and otherwise exploit Your Content, in whole or in part, in any manner and for any purpose, in all media and formats now known or developed in the future.
This licence expressly includes commercial and promotional use — for example using your stadium photo as the main image of a venue in the app, in shareable cards, in app store screenshots, on our website, in social media posts, in advertising for the Service, and in any successor or related product.
This licence is granted without any obligation to pay you, to credit you, or to notify you, and it applies whether or not you still hold an account.
We may, but are not required to, display your username alongside Your Content. To the fullest extent permitted by applicable law, you waive any right to be identified as the author of Your Content and any other so-called moral or personality rights in it. Where such rights cannot be waived under the law that applies to you, you agree not to enforce them against us or against anyone acting with our permission.
For everything you upload, you confirm that:
All uploads are subject to review before they become visible to other users. We are under no obligation to publish, keep or display any content, and we may refuse, remove, hide, replace or edit any content at any time, with or without notice and for any reason — including because it does not meet our quality standards. Removal from the Service does not automatically end the licence in Section 5.2 for copies already published or used elsewhere before removal.
If you delete Your Content or your account, we will stop displaying that content in the app within a reasonable time. However, the licence in Section 5.2 continues to apply to copies already incorporated into marketing materials, published elsewhere, or retained in backups, and to any anonymised or aggregated data derived from it.
The Service may let you predict match outcomes and take part in other game features. These are free-to-play entertainment features. You cannot stake money, no money can be won, and any rewards consist solely of virtual items as described in Section 6. These features are not gambling or betting services, and nothing in the Service should be understood as betting advice.
The Service is funded in part by advertising, which we may display in any part of the app. Advertisements are delivered by third parties and their content is not ours; we do not endorse advertised products or services, and any dealings with an advertiser are between you and them. How advertising data is handled, and how to change your consent, is set out in our Privacy Policy.
We may offer optional paid features or subscriptions. If we do:
Club names, competition names, stadium names, and any associated trademarks are the property of their respective owners. Where such names appear in the Service, they are used descriptively, to identify the club, competition or venue concerned.
Gostado is an independent supporters' application. It is not affiliated with, endorsed, sponsored or approved by any football club, league, federation, competition organiser or stadium operator.
Fixture, result, line-up and statistical data is licensed from third-party providers and remains theirs. You may not extract, copy or redistribute that data from the Service.
The Service itself — including its software, design, layout, graphics, generated club and competition emblems, generated stadium artwork, text, and the Gostado name and logo — belongs to Tungo Media or its licensors and is protected by intellectual property law. We grant you a personal, limited, revocable, non-transferable and non-exclusive licence to use the Service for your own non-commercial purposes, in accordance with these Terms. All rights not expressly granted are reserved.
We are a small operation and the Service is provided on a best-efforts basis. We may change, suspend, limit or discontinue the Service or any of its features at any time, including removing content, resetting seasonal data, or ending the Service altogether. We will try to give reasonable notice of significant changes where we can, but we are not obliged to maintain any particular feature.
Some features may be offered as previews or beta features and may be unstable or withdrawn without notice.
You may stop using the Service and delete your account at any time. We may suspend or terminate your account, remove your content, or restrict your access if you breach these Terms, if we are required to by law, or if your use of the Service risks harm to other users, to third parties, or to us. Where it is reasonable and lawful to do so, we will tell you why.
Sections 5, 6, 10, 11, 14, 15, 16 and 19 survive the ending of this agreement.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any data shown in it is accurate or complete.
Content submitted by other users is their responsibility, not ours. We do not endorse it and we do not systematically verify it beyond the moderation described in Section 5.5.
To the fullest extent permitted by law, Tungo Media is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or in connection with your use of the Service.
Where we are found liable, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) EUR 100.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, your mandatory statutory rights are not affected by these Terms.
If you use the Service in breach of these Terms or of the law, you agree to compensate us for any reasonable claims, damages, losses and costs (including reasonable legal fees) that a third party brings against us as a result — for example, a claim by a photographer, or by someone shown in a photo you uploaded without permission. This does not apply to the extent that the claim results from our own act or omission, and does not apply beyond what the law allows in relation to consumers.
If you believe that content in the Service infringes your rights — including a photograph, a trademark, or your image — contact us at support@tungomedia.nl with a description of the content, where it appears in the Service, and proof of the right you hold. We take such reports seriously and will remove infringing content promptly once verified.
We may update these Terms from time to time. The current version is always published on this page with its version number and date. If a change is material, we will notify you in the app or by email before it takes effect, and where required we will ask you to accept the new version. If you do not agree to the new version, you should stop using the Service and may delete your account. Continuing to use the Service after a change takes effect means you accept it.
These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands. If you are a consumer resident in the European Union, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, nor of your right to bring proceedings before the courts of that country.
